view full text »The Jurist Magazine (issue 2012/ ¹ 2) has published an article written by Businessconsult senior associate Vladimir Tkachenko with the headline “The Concept of Similarity of Goods”. In his article Vladimir Tkachenko analysed judicial practice on recovery of damages involving the price difference between the initial supply agreement, under which the goods were not supplied, and the price, which was actually paid for this goods. It was established to the satisfaction of the court that the similarity of item names did not allow to consider the goods similar, because their price differed substantially due to parts kitting, etc.
